Presentation Before the Disinvestment Commission

SCOPE made a presentation before the Disinvestment Commission. Most of the suggestions given by SCOPE were included by the Commission in its reports.

Review of Guidelines

With SCOPE’s efforts government set up a Committee under the chairmanship of Mr. N. Vittal, the then, Chairman, PESB to review the guidelines and to recommend cancellation/redrafting and/or simplification of these guidelines. On recommendation of the Committee, government deleted 696 guidelines and retained 196 guidelines.

Government recently formed another committee under chairmanship of Mr. T.K.A. Nair, Chairman, PESB to review the guidelines. SCOPE Chairman is one of the members of the Committee. The Committee has submitted its report to the Government.

Public Sector Executive Remuneration

SCOPE made a presentation before the Justice Mohan Committee and submitted its recommendation on pay scales for board and below board level executives. Later, SCOPE sent comments/suggestions on the recommendations on the Pay Committee to the Government.

Chapter on Vigilance

SCOPE had earlier suggested revamping of vigilance policies. SCOPE and CVC jointly held meetings and workshops to secure integration of vigilance functions in the management structure systems and procedures of PSEs. A Special Chapter on “Vigilance Management in Public Sector” has finally been notified by CVC. SCOPE also requested CVC to consider some circulars issued by it to which CVC has advised necessary modification.

Issue of Purchase Preference

SCOPE on behalf of its member enterprises took up with the government the issue of purchase preference in products and services of PSEs. On SCOPE’s requests the government has extended the policy for two years and that also reduced the minimum value of purchase order to that more enterprises can avail on the benefit.

Contract Labour and Labour Reform

Hon’ble Supreme Court of India had passed a judgement in December 1996 in the Air India case relating to “Appropriate Government” and the “automatic absorption” of contract labour. Since the judgement had affected profitability and working of many PSEs, SCOPE filed an intervention application in the Supreme Court in 1998 along with the Special Leave Petition of FCI, SAIL and others praying for review of its pronouncements
SCOPE’s application was admitted and the arguments before the Constitution Bench were concluded in March 2001. On 30th August 2001, Hon’ble Supreme Court gave its landmark judgement relating to Contract Labour reversing its 1996 ruling in the Air India Statutory Corporation case and quashing the notification of the government dated 9th December 1996.
SCOPE is now stressing the need for reform and rationalization of labour laws including Industrial Disputes Act, Trade Union Act etc for enabling PSEs to remain competitive.

Interactions and Submissions to Parliamentary Committee

SCOPE had submitted to the Parliamentary Committee on PSUs various documents submitted by SCOPE to the government from time to time on “Financial Restructuring and Disinvestment”.
SCOPE had also recently submitted a memorandum to COPU on disinvestment and privatization of Indian public sector.

SCOPE’S views before the Parliamentary Committee on Petitions

On invitation of the Parliamentary Committee on Petitions, SCOPE Chairman and DG expressed views before the Committee regarding privatization of NALCO. The views expressed were highly appreciated by the Members of the Committee.

Priority Issues recently discussed with the Government

The future of Presidential Appointees on the Boards of the companies being privatized
Adequate incentives and special provisions to encourage professionals with a proven record, who can take up the challenging assignment of effecting turnaround of sick and non-profitable enterprises.
Review of the move to roll back the retirement age of Presidential appointees from 60 to 58 years
Removal of Restriction on employment of Board level executives after retirement/resignation
Labour reforms
A road map for disinvestment/privatization
Review of Strategic sales of profit making enterprises
Offering shares of the companies to be privatized to the profit making blue chip PSEs and the public
Methodology of valuation of the assets and market goodwill of the companies being privatized.

Budget Memorandum

SCOPE sent a Pre-Budget Memorandum consisting of three parts : Direct Taxes, Indirect Taxes and Industry Specific Issues to the Finance Minister.

Corporate Governance in Public Enterprises:

SCOPE held a meeting to discuss Naresh Chandra Committee’s Report on Corporate Governance. The suggestions emerged at the meeting was sent to Secretary Department of Company Affairs and The Secretary, DPE.


Presentation made before the Group of Experts:

Chairman SCOPE made a presentation before the Group of Experts on the issues relating to Empowerment of CPSEs. He made suggestions in the area of business administration audit and vigilance administration.
